Cette clause a pour objectif de limiter la possibilit\u00e9 d\u2019exercer des fonctions similaires chez un concurrent ou \u00e0 son propre compte et causer du tort \u00e0 son employeur.<\/span><\/p>\n<p style=\"text-align: justify\"><span>En ce qui concerne l\u2019<strong>exercice\u00a0lib\u00e9ral des professions de sant\u00e9<\/strong>, la notion de clause de non-r\u00e9installation est parfois employ\u00e9e. Cette\u00a0clause\u00a0s\u2019exerce\u00a0de mani\u00e8re diff\u00e9rente en fonction du statut et du cadre contractuel dans lesquels se trouve le m\u00e9decin.<\/span><\/p>\n<h2 style=\"text-align: justify\">La clause de non-concurrence dans le cas d\u2019une\u00a0collaboration lib\u00e9rale ou d\u2019association<\/h2>\n<p style=\"text-align: justify\">Dans le cadre d\u2019une collaboration lib\u00e9rale, le m\u00e9decin peut s\u2019installer ou exercer o\u00f9 qu\u2019il ne souhaite \u00e0 la fin de son contrat, dans le cadre du <a href=\"https:\/\/brm-conseil.fr\/offres-demploi-sante\/\">d\u00e9veloppement de sa carri\u00e8re<\/a>. Dans le cadre de sa recherche d\u2019emploi, le praticien a le droit de d\u00e9velopper sa propre client\u00e8le en cas de rupture de contrat avec son pr\u00e9c\u00e9dent employeur. Il ne peut y avoir de clause de non-concurrence dans ce contexte pr\u00e9cis.<\/p>\n<p style=\"text-align: justify\">Dans le cas o\u00f9 le <strong>m\u00e9decin<\/strong> exerce au sein d\u2019une association, la clause de non-concurrence est facultative. Cette clause est obligatoirement limit\u00e9e dans le temps (en r\u00e8gle g\u00e9n\u00e9rale, deux ans) ainsi que dans le rayon d\u2019application. C\u2019est aux deux parties de n\u00e9gocier cette clause dans le cadre du contrat d\u2019embauche global. Certaines dispositions exceptionnelles peuvent annuler cette clause ou en r\u00e9duire le p\u00e9rim\u00e8tre si par exemple le m\u00e9decin partant c\u00e8de sa patient\u00e8le.<\/p>\n<h2 style=\"text-align: justify\">La clause de non-concurrence dans le cas d\u2019une cession de cabinet ou de remplacement temporaire<\/h2>\n<p style=\"text-align: justify\">Il est pr\u00e9vu, de mani\u00e8re non obligatoire, une <a href=\"https:\/\/brm-conseil.fr\/2020\/04\/06\/travailler-comme-medecin-en-france-quelles-sont-les-demarches-a-effectuer\/\">clause de non-concurrence<\/a> dans le cas d\u2019une cession de cabinet du m\u00e9decin \u00e0 une tierce personne. Le\u00a0Conseil national de l\u2019Ordre pr\u00e9voit que\u00a0la personne qui c\u00e8de le <strong>cabinet\u00a0<\/strong>s\u2019engage \u00e0 ne pas exercer la profession m\u00e9dicale soit directement, soit indirectement, dans un rayon\u00a0et sur une dur\u00e9e \u00e0 d\u00e9terminer. Cette clause peut \u00eatre retir\u00e9e ou am\u00e9nag\u00e9e par les deux parties. Afin d\u2019\u00e9viter tout litige ou situation \u00e9quivoque,\u00a0il est fortement recommand\u00e9 de pr\u00e9ciser l\u2019application ou non de cette clause, notamment si elle doit couvrir les activit\u00e9s salari\u00e9es ou hospitali\u00e8res.<\/p>\n<p style=\"text-align: justify\">Dans le cadre d\u2019un <strong>remplacement<\/strong>, il est fortement stipul\u00e9 par le Conseil national de l\u2019Ordre que le rempla\u00e7ant, s\u2019il exerce pendant 90\u00a0jours cons\u00e9cutifs ou non au minimum, ne peut s\u2019installer et exercer des <a href=\"https:\/\/drees.solidarites-sante.gouv.fr\/IMG\/pdf\/er1137.pdf\">prestations concurrentes<\/a> dans un rayon \u00e0 d\u00e9finir, et sur une dur\u00e9e de deux ans.
